Our loved ones may reach a point in life where they can no longer make good decisions for themselves. They need someone to make important decisions for them. A family member, friend or professional guardian can be court-appointed to advocate for and support our loved one.
Guardianship is the legal process of naming someone to manage the personal affairs and/or the financial affairs of an incapacitated adult or a minor child. The guardianship of the person gives the guardian authority to handle an incapacitated person’s personal affairs such as moving him from home to a nursing home or consenting (or not consenting) for medical care. The guardianship of the estate gives the guardian authority to handle an incapacitated person’s financial and/or property matters, such as selling his home or paying his bills.
