North Carolina will uphold a covenant not to compete as long as the terms are reasonable as to the length of time and geographical distance. In North Carolina, if a covenant not to compete is found to be unreasonable, then only the parts that are unreasonable will be stricken and the remaining portions will be enforced. To be an enforceable, a covenant not to compete must:

  • Have been agreed to as a condition of employment.
  • Have been entered into for other sufficient consideration.
  • Be limited in scope for a reasonable time period for a particular industry.
  • Be limited in scope for a specific geographic region.
  • Be restricted to a legitimate business interest.
